Terms & Conditions
Commencement of work
- Receipt by Just Say Ah Graphic & Web Design (JSA) of written or verbal request to commence work from the Client will be taken as an indication of agreement of costings, timings and terms and conditions as detailed below.
- JSA will only be required to fulfil the instructions specified in the quote. JSA will not be responsible for errors or omissions due to misinterpretation of verbal instructions.
- Modifications to the brief after commencement
Design fees are fixed fees, and will only be altered if the scope of the project is changed and/or if alterations are made following an approval to proceed. Any modification made by the client of the assignment must be by written email. - The suspension by the Client of any work, for any reason whatsoever, for a period of thirty (30) days, entitles JSA to payment in full for the work completed up to the suspension date.
- Urgent / Rush Jobs
The Client acknowledges that a requirement for urgent delivery increases the likelihood of a less than optimum result. JSA will provide every effort to deliver the best possible result but will not be liable for a less than optimum product arising because of urgent delivery or a change in brief. JSA reserves the right to charge an additional 30% above the quoted amount in this circumstance. - JSA will not be liable for insurance, freight or loss or damage to goods in transit incurred in delivery.
Approval and artwork
- Approval
The Client shall be required to approve (manually or via email) final art/printing proofs, pdfs etc. as authorisation to proceed with reproduction in all media. Such a signature/authority shall represent acceptance in full of any work produced by JSA for the Client. - Changes &/or Authors
Work in amending or adding to final art after signed approval to proceed with reproduction or printing shall be borne by the Client and is subject to studio rates and/or any out-of-pocket expenses incurred of the assignment. - Ownership of Artwork
JSA shall retain ownership of all original working digital files/source/finished artwork files until an Artwork Approval form is completed. - Supply of artwork only and/or templates
Any artwork supplied by JSA must be paid in full prior to use. - Website design credit
The Client agrees to allow JSA to place a small credit on the client website. This will be in the form of a small link placed towards the bottom of the page - Site designed by www.justsayah.com.au. - The Client also agrees to allow JSA to make use of samples of the design work, either printed or electronic, for self promotional purposes.
Payment
- First order: Graphic Design and Website Design only - 50% deposit with your quote approval and 7 Days for completed work. Printing on first order - Strictly COD.
- Subsequent orders: 7 day terms.
- The Client agrees to pay the agreed deposit on commencement of any project with the balance payable on delivery. We will require authorisation to proceed with work prior to commencement. Any supplied material shall be received prior to commencement of work.
- Out of pocket expenses
Fees and expenses shown are estimates/quotes only. The Client’s approval shall be obtained for any increases in fees or expenses that exceed the original estimate before proceeding. - Any expenses incurred due to changes in specifications by the Client or any unforeseen requirements after commencement require additional approval and will be passed on by JSA to the final invoice.
- Cancellation
In the event of a cancellation of an assignment, ownership of all copyright and the original artwork shall be retained by JSA and compensation for work completed and/or any expenses incurred, shall be paid by the Client.
Electronic data + storage of work
- Any final artwork or computer data produced by JSA shall be archived Free Of Charge for a period of 3 months from the date of completion of work at which time JSA may exercise the right to dispose of the material unless other arrangements have been requested by the Client within this period.
- The Client shall be responsible for costs of any necessary DVD and/or CD duplication costs and downloading of the above mentioned material. Studio rates commence at $25+gst per job.
Liability
- JSA can not be held liable for any errors arising from third party suppliers selected by the Client. Completion and despatch of artwork is acceptance by the Client the project has been completed and will be invoiced accordingly.
- JSA can not be held liable for any errors or print quality arising from Client Supplied Artwork. Supply of artwork to JSA is acceptance by the Client the project is to proceed and will be invoiced accordingly.
